This policy applies to all processing of personal data carried out by Thermotech Combustion and aims to inform the user about how Thermotech Combustion processes personal data (including details of the type of personal data collected and the purpose of the processing and the user’s rights in relation to their personal data.

IDENTIFICATION OF PROCESSING – HOW DO WE COLLECT PERSONAL DATA?

In accordance with current regulations on the protection of personal data, in particular the Act to modernize legislative provisions on the protection of personal information (Act 25).

Thermotech Combustion collects personal data in its possession when the user:

  • Fills in forms on the site
  • Subscribes to our newsletter
  • Responds to a survey
  • Fills out a printed form
  • Sends an e-mail or communicates by telephone

PERSONAL DATA COLLECTED – WHAT PERSONAL DATA DO WE COLLECT ?

Thermotech Combustion collects information when you visit their web page, primarily by completing online forms.

The following data is collected:

As a general rule, where personal data is required to use a service or access certain content, its provision will not be compulsory, except in cases where it is specifically indicated that this data is required for the provision of the service. In this case, the user may freely choose not to register and/or not to contract the services.

The User declares and guarantees that all data provided by him/her is true and accurate, and undertakes to keep it up to date. Changes may be communicated to the Data Protection Officer or to the address indicated in the Contact section above.

Likewise, the user acknowledges that the data required by Thermotech Combustion are necessary, adequate and not excessive to achieve the purposes expressed, which would be impossible to achieve if these data were not provided.

Any false or inaccurate statement resulting from the information and data provided, as well as any damage that such information may cause, will be the responsibility of the user.

Purpose – What is the purpose of the personal data we collect ?

The personal data requested from the user will be used for the following purposes:

In the event of a contract for services offered on the site, to create and maintain the commercial relationship and to carry out the activities and provide the services of Thermotech Combustion (including, without limitation, the management, administration, provision and improvement of services).

To send newsletters, as well as commercial communications, promotions and/or advertising from Thermotech Combustion, either occasionally or periodically. Accordingly, the email address that the user provides when completing the form on the site may be used to send information and updates on the request for services, as well as news about Thermotech Combustion (either occasionally or periodically), updates, information on related products or services, among others. This processing is based on our legitimate interest in promoting our products and services.

To personalize the user experience, increasing our ability to meet their needs.

Improve Thermotech Combustion’s website and service offering, based on Thermotech Combustion’s legitimate interest in constantly improving its products and services.

To process transactions and comply with legal obligations to which Thermotech Combustion is subject, such as tax obligations.

The data submitted for processing will not be used for purposes other than those mentioned above, which motivated their collection. Notwithstanding the foregoing, it is specified that the recorded data may be used, in addition to the purposes for which they were expressly collected, for statistical, incident management, or market research purposes. However, in the event of personal data processing for purposes other than those initially specified at the time of collecting such data, a compatibility analysis will be conducted by Thermotech Combustion in accordance with applicable regulations. Processing will only be authorized if the initial purpose is compatible with the new purpose or authorized in compliance with an independent legal basis. In these cases, the user will be informed of the changes in purpose or the legal justification for processing their data. We remind the user that they can object to the sending of commercial communications (unsubscribe) and no longer receive emails from Thermotech Combustion, by reliably informing Thermotech Combustion, which will promptly cease such communication upon receipt of such notification. How do we use your information ?

We will use the information we collect about you for the following purposes:

If we want to use your information for other purposes, we will ask for your consent and will only use your information when you have given your consent and only for the purpose (or purposes) for which you have given your consent, unless required otherwise by law.

We will retain your personal information with us for an indefinite period after user accounts are no longer active or for the duration necessary to fulfill the purposes for which they were collected, as stated in this privacy policy.

Consent

By providing personal data to Thermotech Combustion, the user declares to fully and unreservedly accept their processing by Thermotech Combustion. The user hereby grants free, express, and informed consent to Thermotech Combustion to use the data collected for the purposes stated in the Purpose section above, as well as their incorporation into third-party databases/applications used by Thermotech Combustion.

Thermotech Combustion legitimizes the processing of user data through: (i) the conclusion of a service contract with Thermotech Combustion by the user, in accordance with the terms and conditions made available to the user at the end of the service request form (prior to potential hiring), which the user, after reviewing, and if in agreement, can accept by checking the designated box provided for this purpose; and (ii) the free, informed, and unequivocal consent of the user, given after reviewing this privacy policy where Thermotech Combustion informs about the processing it will carry out with your data, and if in agreement, by checking the designated box provided for this purpose in the service request form. The processing of data not covered by one of the legal bases mentioned above will be carried out if Thermotech Combustion deems it necessary to protect a legitimate interest and only if it does not infringe upon the fundamental rights and freedoms of the user.

Expiration – How long do we keep them ?

The data will be destroyed or archived when they are no longer strictly necessary or relevant for the purposes detailed in the Purpose section above. In particular, personal data will be retained as long as the business relationship is in effect (and unless the user has previously requested their deletion) and during the period in which obligations, indemnities, and/or liabilities may arise within the scope of the business relationship or for services provided. Thermotech Combustion informs that it will retain essential information to identify the origin of stored data for the duration of the customer relationship with Thermotech Combustion and/or the revocation of the user’s consent in accordance with the information provided in the Consent section of this privacy policy and/or for the duration required by applicable law.

Confidentiality / Assignment / International Transfer – Do we disclose data to third parties ?

Thermotech Combustion will keep the personal data collected privately and confidentially and will not use them for purposes other than those established in the Purpose section above. Thermotech Combustion requires its employees and third parties who provide services accessing database content to sign confidentiality and personal data processing agreements (or include such obligations in the service agreements it signs with such providers as indicated in the following paragraph).

The user’s personal data collected by Thermotech Combustion will not be transferred, sold, exchanged, transmitted, and/or disclosed to third parties outside of Thermotech Combustion without the user’s consent, except for legal obligations and/or for the purpose of providing services to the user. This does not include certain employees and service providers who enable Thermotech Combustion to keep the site operational, to comply with the purposes established in the Purpose section above, and/or to provide services to the user, who have undertaken the obligation to maintain the confidentiality of the provided data and are committed to complying with applicable data protection regulations at the time of hiring. Contracts with service providers stipulate the purpose, scope, content, duration, nature, and purpose of data processing, the type of personal data, categories of data owners, and the obligations and responsibilities of Thermotech Combustion and contractual third parties.

In particular: Thermotech Combustion may share the provided personal information with control companies, subsidiaries, affiliated companies, related companies, and/or intermediaries related to Thermotech Combustion.

Thermotech Combustion may internally share certain personal information provided by the user within Thermotech Combustion, with specific departments such as administration, marketing, or IT.

Social Networks. Thermotech Combustion also uses social networks, such as LinkedIn, and has integrated features of these networks into its services. The user can only use these social networks to the extent that they are registered and have accessed the corresponding social network with their user account. These social networks have their own privacy policies and terms and conditions, over which Thermotech Combustion has no interference or control.

Finally, the user should be aware that Thermotech Combustion may (and Thermotech Combustion reserves the right to) disclose their information in the following cases: (i) if required by a judicial or administrative authority; (ii) if necessary to exercise your rights under Thermotech Combustion’s terms and conditions and this privacy policy; (iii) if necessary to comply with the law; (iv) if such data could be useful for protecting the rights of third parties; (v) when they are useful for protecting the rights, property, or safety of Thermotech Combustion, its controllers, subsidiaries, affiliates, officers, employees, users, or the general public; and (vi) when there are valid reasons related to public safety, national defense, or public health.

Security – How do we ensure data security ?

Thermotech Combustion declares its intention to adopt the necessary technical and organizational measures to ensure the security, integrity, and confidentiality of data in accordance with the provisions of the law modernizing legislative provisions on the protection of personal information (Law 25) in order to prevent their alteration, loss, unauthorized access, or processing.

Thermotech Combustion does not guarantee absolute privacy in the use of the site, as it cannot be ruled out that unauthorized third parties may become aware of it. The user acknowledges that existing technical security means are not impenetrable and that even with all reasonable security precautions, it is possible to undergo manipulation, destruction, and/or loss of information. In the event of the detection of a security incident involving a significant risk to the data owner, this event will be promptly communicated to the competent supervisory authority, as well as the corrective and palliative measures implemented and/or to be implemented.

Thermotech Combustion is not responsible for the loss or deletion of data by users. Similarly, Thermotech Combustion accepts no liability for any potential damage caused by computer viruses.

Finally, the user should also take steps to protect their information. Thermotech Combustion insists that you take all precautions to protect your personal information when you are on the Internet. At the very least, it is advisable to change your password periodically, using a combination of letters and numbers, and to ensure that you are using a secure browser.

Data Owner Rights and Procedures for Exercising Them – What rights do I have as the data owner ?

The data owner user can exercise the rights of access, rectification, cancellation, opposition, limitation of processing, portability, confidentiality, and deletion concerning their personal data at any time, in accordance with the provisions of the law modernizing legislative provisions on the protection of personal information (Law 25). The exercise of these rights can be done by the user themselves via email at caguilar@thermotech.ca, or by written communication addressed to the data protection officer at the following address caguilar@thermotech.ca, or by any of the means provided by the aforementioned applicable regulations. Thermotech Combustion may request the necessary data to validate the identification of the data owner.

The deletion of certain data will not be carried out when it could cause harm to the rights or legitimate interests of third parties, or when there is a legal obligation to retain the data.

Training – Do we undergo training ?

The Thermotech Combustion staff whose functions are related to the processing of personal data receive training to ensure better protection of personal data and the rights of their owners

Does our Site contain links to other sites ?

The site may contain links to third-party sites, with or without advertising content, whose privacy policies are unrelated to Thermotech Combustion. Linked sites are not affiliated with Thermotech Combustion, and their existence does not imply any suggestion, invitation, or recommendation to visit the destination sites, or any link or association between Thermotech Combustion and these sites. Thermotech Combustion is not responsible or liable for the content, use, and activities of these linked sites, nor for any damages, whether current or potential, material or moral, direct or indirect, suffered by users and derived from the information contained in these sites or from the relationship that users may establish with third parties whose services have been published on the site. However, any feedback regarding these linked sites will be valuable for Thermotech Combustion to improve services and/or ensure the integrity of the site. Thermotech Combustion is committed to doing everything possible to prevent the existence of links to sites with illegal content on its site.

Cookies – Do we use cookies?

When the user enters the site, Thermotech Combustion may store information on their computer in the form of a ‘cookie’ or similar file. The site uses cookies to (i) track advertising, (ii) collect data on site traffic, and (iii) enhance the user experience when using the site.
